Workshop Terms and Conditions

1. Parties and application

These Terms and Conditions apply when a customer asks Robo-Tek International (Robo-Tek, we, us or our) to inspect, diagnose, maintain, service, repair or assess equipment. They apply unless we agree otherwise in writing. They operate together with any applicable quotation, Product Warranty Page, Product Warranty Terms and User Guide. If there is an inconsistency, the applicable product-specific Product Warranty Page or Product Warranty Terms prevail to the extent of that inconsistency for the scope and period of the voluntary warranty. Rights that cannot lawfully be excluded prevail over all documents.


2. Acceptance of service

By authorising work, delivering equipment, arranging collection or approving a quotation, the customer agrees that these Terms and Conditions apply to the work requested.


3. Estimates and quotations

An estimate or quotation is based on the information and condition reasonably available at the time. Dismantling, testing or repair may reveal additional faults or damage. If additional work would materially increase the price or change the scope, Robo-Tek will seek approval before proceeding, except where urgent action is reasonably necessary to address an immediate safety risk and it is not practicable to obtain instructions. Quotations are valid for 30 days unless otherwise stated.


4. Diagnostic and inspection charges

A disclosed diagnostic or inspection fee may apply for fault finding, testing, dismantling, reassembly, reporting and preparation of a quotation. A reasonable diagnostic charge may remain payable if the customer does not proceed or no fault is found. No diagnostic charge applies where the work is accepted as a valid Robo-Tek warranty claim or where the Australian Consumer Law requires assessment and remedy without charge. Potential charges will be reasonably estimated before they are incurred.


5. Labour charges

Labour is charged at the current disclosed rate and may include diagnosis, repair, cleaning needed to perform the work safely, assembly, testing and quality checks. Labour is not charged for work accepted as a valid warranty or ACL remedy, except for separate maintenance or customer-requested work not required to remedy the covered fault.


6. Replacement parts

Parts may be genuine, OEM, superseded, refurbished or suitable quality alternative parts depending on availability, product age and the approved quotation or warranty remedy. Robo-Tek will obtain approval before using a materially different alternative that affects price, performance or appearance. Where parts are obsolete or unavailable, repair may not be possible; any applicable product warranty or Australian Consumer Law remedy will still be considered. Removed parts may be retained for warranty or manufacturer assessment unless return is requested before work begins and is lawful and practicable.


7. Freight, collection and delivery

The customer must follow reasonable packing and transport instructions. Original packaging is not mandatory for an ACL claim. For a confirmed covered fault, Robo-Tek will pay or reimburse reasonable transport costs approved in advance and arrange collection or attendance for large, heavy or hard-to-return equipment where required by law. If no fault is found, or the issue is not covered or is only partly covered, reasonable freight, collection, inspection and redelivery costs may be charged if disclosed or estimated before the cost is incurred.


7A. Loan units

7A.1 Robo-Tek may offer a temporary loan unit while a customer's equipment is being assessed, serviced or repaired. Loan units are subject to availability, suitability and approval and are not guaranteed.

7A.2 Unless agreed otherwise in writing, the loan fee is $50 including GST  plus freight, for the first seven calendar days, then $7.15 including GST per additional calendar day, capped at $50 including GST for each further seven-day period. Charges continue until the unit and all supplied accessories are returned, except where delay is caused by Robo-Tek.

7A.3 Before a loan unit is issued, the customer must sign a Loan Unit Handover Acknowledgement identifying the unit, accessories, recorded condition, applicable charges and return requirements.

7A.4 The customer must follow the supplied instructions, use the loan unit only for its intended purpose, take reasonable care of it, keep it secure and not lend, transfer, alter, dismantle or arrange repair of it without Robo-Tek's written approval.

7A.5 The customer must stop using the loan unit and notify Robo-Tek promptly if it is lost, damaged, unsafe, faulty or not operating as expected. The loan unit and all supplied accessories must be returned promptly when requested or when the customer's equipment is ready for collection or return, unless otherwise agreed in writing.

7A.6 The customer may be responsible for reasonable repair or replacement costs for loss, theft, missing accessories or damage caused or materially contributed to by the customer's misuse, failure to follow instructions, unauthorised work or failure to take reasonable care. This does not include fair wear and tear, an inherent fault, or loss or damage not caused or materially contributed to by the customer.

7A.7 Nothing in this clause excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded.


8. Warranty assessment

Product warranty periods and conditions are stated in the applicable Product Warranty Page and Product Warranty Terms. Robo-Tek may inspect, test and obtain technical information, photos, video, logs, hour readings and service records. Manufacturer technical support may be used internally, but customers will not be required to pursue an overseas manufacturer instead of Robo-Tek where Robo-Tek is responsible for the claim.


9. Paid repair work and supplied parts

Paid repair work and replacement parts supplied by Robo-Tek remain subject to any applicable consumer guarantees under the Australian Consumer Law. No separate fixed-period warranty applies unless Robo-Tek agrees otherwise in writing.


10. Customer responsibilities

Customers must provide accurate information, reasonable proof of purchase where required, remove personal items, back up data where possible, follow safety and maintenance instructions, authorise additional work, collect equipment promptly and pay agreed charges when due.


11. Wear, maintenance, misuse and external causes

Unless the law requires otherwise, and except where an applicable Product Warranty Page or Product Warranty Terms expressly provides cover (including extended battery cover or nominated wear-parts cover), the customer is responsible for costs arising from normal wear, consumables, routine maintenance, accident, misuse, unauthorised work, unsuitable chemicals or water chemistry, corrosion, mineral deposits, pests, power problems, third-party systems, site conditions or another external cause. An exclusion is applied only where that matter caused or materially contributed to the problem.


12. Water damage, corrosion and concealed damage

Wet and chemical environments can conceal corrosion, water ingress, deposits or previous repair damage until dismantling. Where concealed damage is found, Robo-Tek will explain and quote additional work where reasonably practicable.


13. Previous repairs and customer-supplied parts

Previous unauthorised work may affect diagnosis, safety and repairability. Robo-Tek is not responsible for faults caused by that work. If Robo-Tek agrees to fit a customer-supplied part, the customer is responsible for its quality, compatibility and performance; Robo-Tek remains responsible for exercising due care and skill in fitting it.


14. Repair limitations

Equipment may contain multiple faults, and repairing one fault may reveal another. Unless expressly included, repair of a specific fault does not mean the whole product has been rebuilt or restored to as-new condition. Robo-Tek will not knowingly perform an unsafe repair.


15. Storage and uncollected equipment

15.1 Equipment should be collected, or return arrangements made, within 14 calendar days after Robo-Tek gives written notice that work is complete, a quotation has been declined, or the equipment is ready for return.

15.2 The first 14 calendar days are free of storage charges. From day 15, Robo-Tek may charge $3.00 per calendar day, including GST, until the equipment is collected or returned.

15.3 Storage charges will not apply to delays caused by Robo-Tek or while an agreed warranty or repair assessment remains in progress.

15.4 Before storage charges begin, Robo-Tek will provide a reminder to the customer. If equipment remains uncollected after further notice, Robo-Tek may take further action available to it.


16. Payment and retention

Payment is due on completion unless agreed otherwise in writing. To the extent permitted by law, Robo-Tek may retain possession of equipment until properly due charges relating to that equipment are paid. Disputed amounts should be raised promptly.


17. Delays outside reasonable control

Repair times can be affected by diagnosis complexity, parts availability, freight, manufacturer support and events outside Robo-Tek’s reasonable control. Robo-Tek will take reasonable steps to reduce delay and keep the customer informed. This does not remove rights where a service is not supplied within a reasonable time under the ACL.


18. Photographs, logs and privacy

Robo-Tek may photograph equipment and record serial numbers, hour readings, logs and test results for identification, diagnosis, quality control, warranty assessment, manufacturer recovery and evidence. Personal information will be handled under the Robo-Tek Privacy Policy and applicable law.


19. Safety issues and recalls

Robo-Tek may stop work, isolate equipment or decline to return equipment in an unsafe operating condition where reasonably necessary. Potential systemic defects and recall matters will be escalated.


20. Liability and non-excludable rights

Nothing in these Terms and Conditions excludes, restricts or modifies a consumer guarantee, remedy or other right that cannot lawfully be excluded. Robo-Tek is not responsible to the extent loss or damage was caused or materially contributed to by misuse, failure to follow instructions, unauthorised work or another external cause. Any limitation of liability applies only to the extent permitted by law.


21. Governing law

These Terms and Conditions are governed by the laws applicable in the State or Territory in which the relevant goods or services are supplied, together with applicable Commonwealth law.


22. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.


23. Repair notice

Where relevant, the repair notice below will be provided separately in writing and brought to the customer's attention before equipment is accepted for repair.

NOTICE GIVEN UNDER THE AUSTRALIAN CONSUMER LAW

Goods presented for repair may   be replaced by refurbished goods of the same type rather than being repaired.   Refurbished parts may be used to repair the goods.

 Where the product can store maps, logs, settings, images, contact information   or other user-generated data, repair, replacement or software reset may   result in loss of that data. Please back up or export data where reasonably   possible before the product is accepted for repair.
